LAW1112 – Legal Writing and Research Assignment 2 – Research Plan and Case Note Description Marks out of Wgt (%) Maximum word count Submission due Assignment 2 40 40 2800 29 May 2017 Assignment 2 has two parts: Part A – Prepare a research plan (worth 10 marks; word count 700 words) Part B – Prepare a case note on a prescribed case (worth 30 marks; word count 2100 words) Objectives This assignment is an opportunity for you to try out both your generic legal writing skills and your understanding of some key points of criminal procedure. It seeks to emulate a task that is given to law students and law graduates in various professional contexts.
The exercise is designed to develop and assess your ability in respect of the following learning objectives for this course: • LO1. Knowledge, including of advancing knowledge of legal systems and of fundamental principles of criminal law procedure; • LO2. Thinking skills, including a developing ability to identify and articulate legal issues, apply legal reasoning and research to generate appropriate and creative responses to legal issues, and engage in critical analysis; • LO3. Research skills, namely the intellectual and practical skills needed to identify, research, evaluate and synthesise relevant factual, legal and policy material; • LO4. Communication skills, namely effective and appropriate writing skills suited for legal and non-legal audiences; • LO5. Self-management, including the developing ability to learn and work independently. My research focus will look at legal cases on the subject Perjury.
The Court of Appeal process and procedure and Perjury in the Supreme Court. The application of the Criminal Code Act which covers Indictment, Arraignment and application of res judicata and issue estoppel in relation to the Queen v Carroll. An examination of the workings of Criminal Law and power of the court in relation to “Double jeopardy” and whether or not Carroll was in fact abusing court process and procedure. I will investigate the history of jury instruction and the impact this had on the verdict. My research will refer to New Zealand Commission report on acquittals as a result of perjury. An aspect of my research will be to determine whether or not Carroll’s intent was to commit the fatal act against Deidre Kennedy knowing that his actions would cause death. What were the circumstances prior to this event and his state of mind?
